Provision of information on tobacco products, herbal products for smoking, electronic cigarettes and refill containers and payment for processing of information submitted to the EU-CEG

The Law “On the Handling of Tobacco Products, Herbal Products for Smoking, Electronic Smoking Devices and Their Liquids” (hereinafter – the Tobacco Law) is in force as of 20 May 2016.

Section 5, Paragraph 1 of the Tobacco Law imposes a reporting obligation on manufacturers and importers. Manufacturers and importers are required to submit to the Health Inspectorate information regarding tobacco products, electronic cigarettes, refill containers, herbal products for smoking and novel tobacco products. Information should be submitted via the EU Common Entry Gate (hereinafter – EU-CEG) developed by the European Commission. Information submitted to the Health Inspectorate of Latvia will be stored in the national data repository of the EU-CEG. The manufacturer of the relevant product shall be responsible for timely and accurate provision of the information referred to in Regulation Nr.440  if he or she conducts commercial activity in the European Union and the European Economic Area. If the manufacturer of the relevant product conducts commercial activity outside the European Union and the European Economic Area and the importer of the relevant product conducts commercial activity in the European Union and the European Economic Area, the importer of the product concerned shall be responsible for the provision of the required information. 

It is forbidden in accordance with Section 3 Paragraph 1 Point 3 of the Tobacco Law to place on the market in Latvia tobacco products, herbal smoking products, electronic cigarettes, refill containers and novel tobacco products for which no information has been submitted before they are placed on the market.

 The fee for the processing of information on products notified at EU-CEG

In compliance with Article 5.8 and 20.2 of Directive 2014/40/EU the Member States may charge manufacturers and importers of tobacco products, electronic cigarettes and refill containers proportionate fees for receiving, storing, handling, analyzing and publishing the information submitted in EU-CEG.

Both above mentioned Articles of Directive 2014/40/EU concerning paying obligation are transposed in Section 5, Paragraph 1 of the Tobacco Law.

The fees are charged in accordance with the Health Inspectorate’s service price-list the Regulations of the Cabinet of Ministers of the Republic of Latvia No 24, January 11, 2022 (available in Latvian).

The fee for receiving, storing, handling, analyzing and publishing information for each notified product is 125,50 EUR for the first-time notification and 78,49 EUR for each notified product annually (entries No 19 and No 20 accordingly in the above mentioned legal act). The Health Inspectorate kindly asks that manufacturers and importers or their affiliated companies in Latvia fill in the application form for invoice and send it to the Health Inspectorate’s e-mail dati@vi.gov.lv

The Health Inspectorate will send an invoice in due time to each of the manufacturers or importers to charge the fee for receiving, storing, handling, analyzing and publishing information in relation to all products for which information has been submitted via the EU-CEG for placing on the market in Latvia.  

If no application form for the invoice is received, the invoice will be sent to the enterprise’s e-mail that is indicated in EU-CEG. The identification number of each product notified via the EU-CEG and total sum calculated in accordance with the Health Inspectorate’s price-list entry No 19 and No 20 will be indicated in the invoice.

Attention to distributors of tobacco products, electronic cigarettes and their refill containers!

The Health Inspectorate informs distributors that when purchasing tobacco products, electronic cigarettes, refill containers or novel tobacco products from wholesalers, it is necessary to verify whether the products have been notified in EU-CEG data base and payment has been made for processing the provided information in accordance with the Health Inspectorate's service price-list.

It is forbidden to place on the market tobacco products, electronic cigarettes, refill containers and novel tobacco products if no payment has been made for the receiving, storing, handling, analysing and publishing of the provided information in accordance with the Health Inspectorate's service price-list.
