The merchant must notify the Health Inspectorate of the marketing of vials for electronic cigarettes or electronic cigarettes prior to the commencement of trade. Such requirement is specified in Section 8, Paragraph nine of the Law on the Circulation of Tobacco Products, Plant Smoking Products, Electronic Smoking Devices and Their Liquids. For notification, the form provided for in Cabinet Regulation No. 593 of 6 September 2016, Procedures by which a merchant shall notify the commencement of the sale of electronic cigarettes and electronic cigarette refill vials and shall be submitted to the Health Inspectorate. It can be easily completed and submitted using the e-service “Application for Health Inspectorate” available on the portal www.latvija.lv (subject: “Trade in electronic cigarettes and electronic cigarette refill vials”).
The use of e-service has a number of important advantages:
• do not have to download the form specified in Cabinet Regulation No. 593 of 6 September 2016, Procedures by which a merchant notifies the commencement of the sale of electronic cigarettes and electronic cigarette refill vials.
• the content fields of the application correspond to the form, they are clearly defined in step 3 of the input – you need to enter the necessary information.
The legal status of the e-service shall be equivalent to a paper-based or e-signature document.
The merchant's duties shall include reporting to the Inspectorate if he or she starts trading in a new place or if the name of the merchant indicated in the previous submission changes, the registered person, the contact person, the planned assortment, the name of the place of sale, the actual address or telephone. The merchant must notify the Inspectorate of the changes referred to above within 14 days.

Process description

  1. Service requests
    The “Application for Health Inspectorate” service is found in the e-Services section of the www.latvija.lv portal using search capabilities.
    In step 1 of the application, the subject of the application “Trade in electronic cigarettes and electronic cigarette filler vials” shall be selected.
    Step 2 fills in the basic information about the applicant.
    Step 3 shall fill in the content of the application. Specify the person and contact person to be signed by the company, if any. Information on the trading venue and the proposed assortment shall be provided. The number of entries for trading venues can be supplemented as necessary.
    Step 4 shall indicate the way in which a response to the application is sought. You can specify the “No Answer Required” response type. In the event of confusion, the Health Inspectorate will contact you.
    Step 5 must check the content of your application. You can copy and save it to another media or print it. Once approved, the existing text content will no longer be available. When the content has been checked - an application shall be submitted.

  2. Receipt of services
    When submitting an appropriately completed submission regarding the marketing of electronic cigarettes and electronic cigarette filler vials, the merchant's obligation to notify the Health Inspectorate prior to the commencement of trade has been fulfilled until changes have occurred in the information provided.
    The Health Inspectorate shall send an approval in the manner chosen by the customer that the information provided has been received. If “No response required” is indicated, the Health Inspectorate specialists shall only contact the applicant in the event of confusion.
    If the Health Inspectorate, in examining the submission, determines that it has not been completed in conformity or is incomplete, it shall, within 30 days of receipt of the submission, request the merchant in writing to specify the submitted information.
    A merchant shall submit the information specified in the Health Inspectorate within 14 days after receipt of the request.
    If a merchant has not received a request to clarify the submitted information within 30 days after the submission of the submission, as well as within 14 days after the submission of the specified information has not received a repeated request referred to in Paragraph 3 of Regulation No 593, the merchant shall be deemed to have fulfilled Section 8 of the Tobacco Products, Plant smoking products, Electronic smoking devices and their fluids. the obligation laid down in the second subparagraph.
