Tobacco products and electronic cigarettes

The Law on Sale of Tobacco Products, Herbal Products for Smoking, Electronic Smoking Devices and Liquids (hereinafter – the Law) is in force as of 20 May 2016.

In compliance with Directive 2014/40/EU, the Article 5.1 of the Law imposes a reporting obligation on manufacturers and importers. Manufacturers and importers shall submit the Health Inspectorate key information regarding tobacco products, electronic cigarettes, refill containers, herbal products for smoking and notifications of novel tobacco products.

Reporting of tobacco products, electronic cigarettes, refill containers already on the market shall be completed by 20 November 2016. Notifications regarding new tobacco products, electronic cigarettes and refill containers, novel tobacco products and herbal products for smoking shall be submitted before they are placed on the market. 

Manufacturers and importers are required to submit their reports via an EU common entry gate (EU-CEG) developed by the European Commission. Information submitted to the Health Inspectorate will be stored in the national data repository of the EU common entry gate (EU-CEG).

In order to submit information via the EU-CEG, submitters are required to apply for a Submitter ID. In order to apply for Submitter ID, download application form (Excel worksheet) from EU-CEG. Complete the form and send it to e-mail address indicated in form. You will receive a confirmation message via e-mail. You will receive further Commission instructions within the next couple of weeks.


The fees for information processing for notified products at EU-CEG

In compliance with Directives 2014/40/EU Article 5.8 and 20.2 the Member States may charge manufacturers and importers of tobacco products, electronic cigarettes and refill containers proportionate fees for receiving, storing, handling, analysing and publishing the information submitted in EU-CEG.

Both above mentioned Articles about paying obligation are transposed in Article 5.1 of the Law. The invoice for products notified at EU-CEG will be prepared in accordance with the Health Inspectorate’s price-list. The fees for information processing are published in Regulations of the Cabinet of Ministers of the Republic of Latvia No 675 “Health Inspectorate’s service price-list” (http://likumi.lv/doc.php?id=259415 available in Latvian).

The fee for receiving, storing, handling, analysing and publishing information for each notified product is 121,96 EUR first-time notification and 75,69 EUR annually (entry No 20 and No 21 accordingly in above mentioned legal act). The Health Inspectorate will send an invoice to each of manufacturers or importers for the notification fees due in relation to all products for which information has been submitted via the EU-CEG.

The invoice will be sent to entrepreneur who owns products notified via the EU-CEG in Latvia. The identification number of each product notified via the EU-CEG and total sum calculated in accordance with the Health Inspectorate’s price-list entry No 20 and No 21 will be indicated in the invoice.
